PT Chat Privacy Policy

This Privacy Policy (“Policy”) governs the manner in which PT Chat, Inc. (“PT Chat,” “Company,” “we,” “our,” or “us”) collects, uses, maintains, and discloses information from users of the PT Chat website, mobile application, and related services (collectively, the “Services”).

By accessing or using the Services, you (“User,” “Parent/Guardian,” “Child,” or “School/District”) acknowledge that you have read, understood, and agreed to the terms of this Policy.

 

What We Collect

For purposes of this Policy, “Personal Data” means information that identifies, relates to, describes, or could reasonably be linked with a particular individual. PT Chat may collect the following categories of Personal Data:

  • From Parents/Guardians: Name, email address, account credentials, and information voluntarily provided regarding a child’s learning profile.

  • From Children (with verifiable parental consent): Learning activity data, participation records, and performance metrics. Children are not permitted to create independent accounts.

  • From Schools/Districts: Teacher and administrator account details, class and roster data, and usage analytics, collected pursuant to written agreements.

  • Automatically Collected Data: Device identifiers, IP addresses, browser type, operating system, usage statistics, and cookie data.

When We Collect Information

We collect Personal Data at the time of account registration, when a Parent/Guardian creates a child profile, when a Child participates in activities within the Services, when a School or District provides roster data under contract, and when Users contact us for support, inquiries, or feedback.

How We Use Your Information

PT Chat uses Personal Data for the following business purposes:

  1. To operate, maintain, and improve the Services;

  2. To deliver personalized educational content to Children and report progress to Parents/Guardians and Schools/Districts;

  3. To enforce compliance with this Policy, applicable Terms of Service, and contractual obligations;

  4. To comply with applicable law, regulation, legal process, or enforceable governmental requests; and

  5. For internal research, security monitoring, and development purposes.

PT Chat does not sell Personal Data. PT Chat does not use Children’s Personal Data for advertising or marketing.

How We Protect Your Information

PT Chat employs reasonable administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access, disclosure, alteration, or destruction. These safeguards include, but are not limited to, encryption of data in transit and at rest, restricted employee access based on role, and routine system monitoring.

Notwithstanding the foregoing, PT Chat cannot guarantee absolute security of Personal Data. To the fullest extent permitted by law, PT Chat disclaims liability for any unauthorized access or use of Personal Data that is beyond its reasonable control.

Cookie Usage

The Services may use cookies or similar technologies to enhance functionality, remember user preferences, and analyze traffic. Users may disable cookies through browser settings, though some features of the Services may not function properly. PT Chat does not employ third-party behavioral advertising cookies.

Third-Party Disclosure

PT Chat may disclose Personal Data in the following circumstances:

  • To Service Providers engaged to perform functions on PT Chat’s behalf (e.g., hosting, analytics), subject to contractual obligations of confidentiality and data security;

  • To Schools/Districts under written agreements that comply with the Family Educational Rights and Privacy Act (“FERPA”);

  • As required by applicable law, regulation, subpoena, or governmental request;

  • To protect the safety, rights, or property of PT Chat, its Users, or the public.

PT Chat does not sell or trade Personal Data to unaffiliated third parties.

California Online Privacy Protection Act (CalOPPA)

In compliance with CalOPPA, PT Chat agrees that Users may visit the Services anonymously. This Policy is accessible via a conspicuous link on the PT Chat website and mobile application. PT Chat will notify Users of material changes to this Policy by posting the revised version on this page and updating the Effective Date.

PT Chat honors “Do Not Track” browser settings and does not engage in cross-site behavioral tracking.

Children’s Online Privacy Protection Act (COPPA)

PT Chat complies with the Children’s Online Privacy Protection Act. PT Chat does not knowingly collect Personal Data directly from Children under 13 without verifiable parental consent. All Child accounts must be created and managed by a Parent/Guardian.

Parents/Guardians may, at any time, review their Child’s information, direct PT Chat to delete such information, or refuse further collection by contacting info@ptchatapp.com.

Fair Information Practices

In accordance with the Fair Information Practice Principles, PT Chat will notify affected Users in the event of a data breach:

  • By email within seven (7) business days; and

  • By in-app or website notification within seven (7) business days.

PT Chat supports the principle of individual redress, which affords Users legally enforceable rights if their Personal Data is misused in violation of applicable law.

CAN-SPAM Act

PT Chat complies with the CAN-SPAM Act. Parent/Guardian email addresses may be used to send updates, respond to inquiries, and communicate information regarding the Services. PT Chat will not use deceptive subject lines or email headers, and each communication will include PT Chat’s business address and a clear opt-out mechanism.

Unsubscribe and Account Deletion

Users may unsubscribe from PT Chat communications at any time by using the “unsubscribe” link in emails or by contacting privacy@ptchatapp.com. Parents/Guardians may also request deletion of their account and associated Child data at any time. If a School or District terminates its agreement with PT Chat, student roster data will be securely deleted in compliance with FERPA and applicable law.

Data Retention

PT Chat retains Personal Data only as long as necessary to fulfill the purposes described in this Policy or as required by law or contractual obligations. Upon request, PT Chat will delete or de-identify Personal Data, subject to any legal or contractual retention requirements.

Governing Law

This Policy and any dispute arising under it shall be governed by and construed in accordance with the laws of the Delaware, United States, without regard to its conflict of law principles.
